Seems like you would want to start by talking to an immigration lawyer.

I would start here: http://www.SBA.gov, the Small Business Administration.

In fact they have an article that talks specifically about your topic: https://www.sba.gov/blogs/starting-b...reign-national

I am pretty sure you an get an LLC or DBA business license. The biggest road block would be real estate. It would be difficult to purchase a place of business and probably impossible to lease somewhere.

This. What they'll tell you is that unless you maybe have a large amount of money that you are prepared to sink into a business here, ideally one aimed at employing a number of Americans, then you're out of luck. The E-2 is probably your closest visa match, but they still want a substantial capital investment in a genuine business - some 'skin in the game' - and it's not an immigrant visa, which means at some point you'd have to leave (as would any kids once they hit 21, if that's an issue).

Sorry

(English expat, came over on L1 visa, now has a GC)

Edit: that is, unless you're already a US citizen? In which case your situation is completely different!

Exactly. Once you are legal, it's easy to start a business.
