Business sues over Cobb’s approval of Braves zoning

An office building owner is suing Cobb County government and the Atlanta Braves over the government approval of the team’s rezoning application for its planned mixed-use development outside the new ballpark in Cumberland.

Fairly Breezy LLC, which owns about two acres of land on Heritage Court, across from the Braves stadium site, filed suit in Cobb Superior Court earlier this month, claiming the county ignored zoning law that requires applicants to be specific about their development plans.

The lawsuit also claims that the Braves threatened to “wall off” owner Fred Beloin’s building if he rejected the team’s offer to buy the property...

The judge may rule that the zoning has to be resubmitted with more detailed plans, which would give us a better sneak-peak into what they are ultimately planning (even if it'd probably get rezoned as the plan evolved).

Lot more to the story behind this one.

The Braves wanted this property so their Windy Ridge frontage would run all the way to the Doubletree. The owners wanted $7 mil for a property they paid $1.8 mil for in 2003. Braves offered $4 mil and allegedly tried some hardball tactics. Owners said no.

Then, supposedly a non-Braves buyer came in and offered $6 mil and the owner still said no. Now, they hire a bunch of lawyers to make everybody's life miserable until they get their way and their $$$.

2 things in this lawsuit . . . it has ZERO to do w/ standing up for the public good . . . and alot of lawyers on both sides are going to make alot of $$$$ at $500/hour.

Yes there is a lot more to shady deal that forced this terribly conceived move to Cobb county, but don't blame businesses for lawsuits, blame the Braves and the full of s h i t county reps who screwed residents.

Heh. The Braves topic is the most toxic thing in Cobb County right now and asking people to look at things objectively is like trying to ask people in the middle of a battle to stop and talk things out. It's why we disassociated Connect the Comet publicly with the whole Braves thing (but under the hood, we're using it to push getting Cumberland ultimately connected to the Atlanta Belt Line via the Silver Comet).

Is there a path that could get from Cumberland to the Comet?

There's three ways, the last one not yet available:
1. Spring Rd to Atlanta Rd to the Silver Comet extension at the Atlanta Rd/ Cumberland Pkwy intersection, then you follow that to E-W Connector past the Publix to the official trailhead at Mavell Rd. This route requires you to cross Atlanta Rd as you switch from Smyrna City limits to unincorporated Smyrna.
2. There's already a trail that goes from the CID down Cumberland Blvd, down Cumberland Pkwy to Mt Wilkinson then over to Spring Hill Pkwy then down Paces Ferry to Spring Hill Rd to Atlanta Rd, then from there it's the same as #1.
3. Opening soon will be a trail along Concord Rd from Atlanta Rd to S. Cobb Dr. When that opens, it will connect the existing trail along Concord Rd near the covered bridge district to the one already along Spring Rd.
