Hey everyone,

I was wondering if anyone here has had experience with evicting someone in Cobb County? If so, what was the process like and what did you have to do?

Since you haven't gotten any responses. I've done them in Winder and Gwinnet.--if that helps.

You can call the magistrate court to get all the info on the dispossery and the sheriff about the eviction. But, more-or-less this is how it goes.


1) you give them some sort of notice that you want tem out.
2) you go to the courthouse to file a dispossery "a dispo". You also may be able to file on-line.
3) they get served the dispo, and you pray that they just move out.
4) you check with the court to see if they are fighting the dispo--if they are you have to show up in court, and show how they are in violation of the lease (either verbal or written lease." (If you have accepted any money from them since the dispo was filed, you probably have to start over.)
5) Once you have won the dispo--you get the "writ" to the sheriff and schedule the eviction. The amount of time this takes can vary a bit.--you may want to check if the sheriff for any cancelations--they may be able to move you up.
6) once you have a date you need to assemble a crew large enough to move the evicted persons belongings to the curb in a couple of hours--check with the sheriff to determine how many movers they want you to have--if it is not enough--the sheriff may bail on the eviction.
In Gwinnett the sheriff will call tow trucks for any cars left on the property, and animal control for any animals left on the property.

7.) Change the locks (All) Especially the Dead Bolts ... Put DB's in if they are not there.
