I had installed about 1000 sq ft of concrete patio (stamped and stained) in my back yard without getting any permits from the city (or HOA). Now that I am considering selling the house, will this patio cause any problems? Will I have to tear it down? I have calculated that I am violating the 45% impervious cover requirement. Do I have any other option other than tearing it down??

I'm sure you poured that patio before the impervious cover requirements were passed and thus it is grandfathered.

Pretty sure there is no permit required for a concrete pad, anyways.

No, there are permits for concrete pads, not sure if they apply in this case.

It depends on your buyer -- and whether or not you disclose this -- you should disclose it, since you clearly know it -- but once it is sold, it is on the buyer. If they ever need permits and the City finds out about the impervious cover issue, they can refuse to issue new permits until the other issues are resolved.

Gpurcell, when do you think the impervious cover limits when into effect? They have been around for a long time!

For the purpose of THIS discussion, it was one year AFTER the patio was poured.

Well, my house was built in 2005 so I cannot argue on that grounds. The house originally came with 200 sq ft patio, which was removed to add the new one.

Do you mind if I ask WHY you would spend all the money on a concrete patio and not take the time to go through the proper channels? Aside from the whole city issue, all it takes is one angry neighbor to turn you into the HOA and you could have to rip it out, landscape to make it look pretty again, AND pay a fine. And now you may have issues selling your home. Doesn't seem worth it to me.
