The BMW driver should be charged with assault for the spitting and BOTH drivers should lose their licenses for a year or more. I am not sure the SUV driver actually tried to hit the other driver but possibly may have wanted to get around him. If he was spit on, he had a right to be mad. When I look at these videos( and they are a guilty pleasure) I often find myself hoping that a driver will pull forward and rip the other drivers door off if ones belligerent enough to stop his car and get out to challenge the other driver. Especially if he starts pounding on the window or starts banging on the car or starts breaking rear view mirrors( which often happens).
Looking at it I guess his AWD or 4WD was his undoing causing his car to flip so easily. Maybe we need to have mental health background checks before we let people get behind the wheel. And we could also look at raising the minimum age of drivers to 18 or possibly 21.

Unless they'd busted your window to get at you and you're boxed in and can't get away, you can't just lower your window and kill someone for that. Well you can, but then you get to spend the next 20 years in a cell.
They just found a guy guilty for killing an ex-NFL player in just that scenario.

While the BMW driver acted badly, the SUV driver took things to the next level.
As a result, the California Highway Patrol has the SUV driver in jail and the BMW driver will be facing lesser charges.

It should be obvious the person in front started it. First of all, he's in front. Secondly, he exited his vehicle...did you miss that part? Or the assault?

If you can't figure out that lethal force is an laughably out-of-proportion response to being berated, and even spit upon, they you're clearly part of the problem. Look in the mirror.

I'm not sure what state this is in, but in a stand-your-ground state you absolutely could shoot to kill if someone came up to your window in a threatening manner.
