This is so unreal. Not even done with accident #1 and now here comes #2. And not only do I not dig on the whole whiplash thing, but I don't use medical doctors (they're reputedly the #1 cause of death and disease), and I don't relish the thought of needing to 'visit' one to satisfy a corporation's (ins. co.,'s) wishes. I have friends who are non-conventional 'healers' and I'm actually one myself. ON TOP OF THAT I'M A PERFORMER, so I CAN'T be physically 'broken' I need to move LITHELY--and I really don't have time to be down for the count!!! We (my 'mate and I, we're musicians) have a showcase/interview FOR TV filming coming up in a week and I'm doing my best here to not be freaking out! So hopefully I'll wake up feeling spry and not 'stuck'.

Ay yi yi yi yi. This is, cosmically speaking, supposed to be some fab-tabulous time and year for me...but it seems the peacock is not showing his tail, so to speak!!!

This is my never-a-dull-moment life--it could be a sit-com or something. Anyways, I need to get back to some other areas of life right now. Thank you all again so much for your time and energy! Have a fun day...and drive nice!!!

P.S. I also just noticed that there are 'rules' and things about posting. Hope I didn't violate anything. And what is this 'positive rep' you sent Gaffer? Is it a good thing like a star or something? Am I being 'rated' for being here? Cuz I'm new? Or does everyone rate everyone? Am I supposed to 'rate'other people? Like you guys? Never mind, maybe I'd better go read 'the 'rules' for this like pronto, since I just dove right in thinking I'd figure it out as I go along...yikes, what a day!

OK, let's start with the car. If there was already prior damage to the rear end, your damage claim has little merit. However, if the damage is new, the other driver's carrier will have to look at it like a completely separate incident. The down side is that your car already had enough damage to be a running total loss. I think you'll do well to see more than a few hundred out of the second accident, but you may do better.

Now, and more importantly, about you. Here's a few thoughts:

1) Let the other carrier know you have been injured.

2) Take some good photos of the back of your vehicle. Take one at a 45 degree angle from the ends of the rear bumper and one right down the bumper from one end to another, and one looking straight at the bumper from behind. Take them for the same height as the bumper, not from a standing position as it will show abnormalities better from the hit.

3) Go to an MD (an MD, not a DC) and get a check-up for any and all symptoms you are having. Follow their advice! If they recommend drug therapy and not physical therapy, ask for it and a recommendation to a physical therapist.

4) If the MD recommends physical therapy, and if you have your heart set on a DC, then do so under the MD's care- and let the DC know it. I know this will rankle people, but a DC is not a diognostic expert. Since I have represneted DC's in malpractice cases, I can tell you they are essentially pysical therapists with special training to extract money out of you and insurance carriers. My personal recommendation is a Physical Therapist as you'll get less static when it comes time to settle the claim and people have this nasty habit of healing better with P/T's.

5) If the advice of the MD isn't working out, get a referral to an orthopedic specialist as you could have a disc issue- do not delay. By the way, a DC is the easiest way to make an unknown disc injury worse, so again please be cautious about using a DC except under the care of an MD. I never recommend using a DC until it is clear if there is a disc injury or not.

6) Once the injury has been diagnosed, treated and you are feeling 100%, then approach the other carrier about settlement.

7) As to the settlement, there are no formulas! The things that matter most are the amount of physical damage, the MD diagnosis, how reasonalbe any treatment was and how long until you were feeling better (trying to stretch out an injury is never a good idea- always play it straight and all the other factors will fit better and actually maximize your settlement). Generally, the carrier will come up 30-50% from their first offer. Be polite and respectful and you should get the same in return.

Hey Blazer, thanks for your quick response! Quick questions: should I notify the other driver-guy first? Or just his insurance company? Or both? What about my insurance company? The thought of contacting and going to a medical practitioner is not pleasant for me. Do you think it's cool to wait another day and see if things seem to be subsiding? or not? I'm being short becuz I have a couple of things I absolutely have to tend to a.s.a.p. and then I can start dealing with these....THANK YOU PROFUSELY!!!

No, if you are in any pain at all it has to be recorded quickly. You are trying to impress the insurance that your well being comes first! The insurance company could even find issues that you made it worse by waiting and skip out of any payment at all.

Do not have any more contact with the other driver. Let his insurance carrier know. Do not be pressured into signing a release. If they want a recorded statement, that's OK. As for wating a few days, no problem. I wouldn't let it go for more then 2 weeks. And, if within those two weeks you get to feeling better, wait at least another 2 weeks before any settlement.

No, you haven't violated any rules.
Off to the right of each post is a short list: "join date"
"number of posts"
"location" (in some cases"
and "reputation"

UPS & DOWNS FOR ANYONE WHO'S STILL AROUND:

The Downside
* The internet connection here was down...then it took me a reeeeally long time to figure out how to get to this 'thread'!
* I don't see some 'posts' and replies I thought I'd made...but I DO see a posting that wasn't done/ready to be posted, yet it somehow got up there(?!)
* Accident 2 ~ Sill feeling it (now even in the arms--typing even hurts, so my time here'll be short) but haven't done anything about it yet
