My candy company would like to sprinkle chopped Andes mints on our chocolate covered pretzels for sale.
Do I need permission? If so how do I get it.

I would not try it without contacting the company to see about permission. It's probably going to be a licensing deal.

On the plus side, with an agreement you can label them as Andes Mints pretzels and that might easily increase sales enough to pay the licensing fee.

If the product is just an ingredient for the final product, and it's purchased in bulk (think hersey chocolate chips) for that purpose, and you are not using their name as part of your marketing, odds are you don't need any more permission than using a brand named sugar as an ingredient.

But, as OWS stated, you may want to check and try and get the permission as it may aide in sales.

I can't imagine Andes sending a cease and desist. "Stop using our product. Your unauthorized use is increasing our profits and we don't like that. Please use M&M's instead."

This is a legal question that cannot be answered here appropriately.
Contact an attorney and at the very least contact the company that produces Andes Mints.
