Hi There, would like some help with insurance company fiasco...anyone that may have gone through this. "First party claim only"

So, my car has been totaled, settlement amount is alright but what concern me is the fact that they (X company) pushing the storage fees to me. They are telling me that shop charged them unreasonable amount $100 per day Vs. $50 per day being the average. Now they are pushing the rest of the amount to me.

Secondly, they took 1 week to get an adjuster to inspect the car, and now telling me that they have total "Six" business day by LAW in NY to inspect it. So, they inspected it accordingly. Really there is such thing??? or bogus?

Finally, Medical adjuster with payment--keep informing me that the process will be delayed because it happened night time (1AM) and they need to investigate (drugs, alcohol, police report, etc) I don't drink nor do drug. Police was present at the scene, report was made at that time however no report were provided..they just came took down our info etc and went about their business...no major injury thankfully other than myself.

Can someone shed some light into all of these dilemma? How I should proceed? They are giving me the run around with shop, storage fees on settlement, and now medical, etc.

It strikes me from the way this post is written that you speak English as a second language.

There is much to the car insurance car system in the United States. My advice is don't attempt to do all this by yourself without advice. You don't answer a number of questions that I had. For example:

1. Are you dealing with your insurance company or the other driver's insurance company?

2. Who was at fault in causing the accident? You or someone else?

3. Is the sole reason the storage charges were incurred the one week delay that it took the insurance adjuster to inspect y our car?

4. What are your injuries?

I think whether you are at fault or someone else is that you ought to speak to a lawyer in about how to proceed. A lawyer in your state will give you better advice than people here on CDF.

It's been nearly a month and many of your issues have been resolved?
Who decided where your car would be taken?


Next time ask the police to call one for you from their list.
Same day or next day call the insurance company and ask them if they might be working with a local area lot so that the insurance company actually chooses a lot at a price they can accept.
Yours was a high $100 a day as ours was $25 a day and as far as time limit, it took over 3 weeks for us to be able to move the vehicle to our location.
