I’m doing some research looking for realtors in South Carolina and the one I spoke to today insisted I sign an exclusivity contract. When I hesitated he said it was state law that I had to sign it otherwise he couldn’t represent me, show me houses, etc. He stated that any realtor I wanted to hire in SC would insist I sign one or they wouldn’t represent me. I think This particular realtor is being extremely dishonest as I can’t imagine there’s a law stating I have to sign an exclusivity contract with an agent. I would appreciate any thoughts on the issue. Thanks.

I'm not a realtor but I didnt have to sign nothing for my realtor to show me houses when I moved here and fir my second house

There's no such state law that I've heard of but my broker doesn't like us showing houses without an agreement at least in part for liability issues.

I'm fine with signing a short term (ie; one day) agency agreement though. I've only once had a client switch to another Realtor once I've started working with them so I'm pretty confident that someone want will continue with me. I also write into my contracts that either party can terminate the contract with 24hrs written notice. I wouldn't want someone to ever feel they were "stuck" with me if they weren't happy with what I'm doing.

What restrictions, etc. would there be if after the expiration of your short term contract, one decided to buy one of the homes you showed them?

The way the contract is written, if a client asks me to show them a house and then buys that house within 365 days, I would earn a commission. 99% of the time it is the seller paying the commission which they've agreed to via the MLS listing.
