here is the situation, i have leased a warehouse for almost 2yrs.. lease expires on 6/30... my lease reads that i pay for the water that i use and i pay a percentage for snow plowing..

i have never paid the water (in 22mos) or snowplowing..

why? landlord wants a percentage of building space = amount to pay for water and snowplowing.

my unit is 10000sf, building is 50000sf so he wants me to pay 20% of water bill which i refuse to do since i dont even have a water spicket, just a toilet.. bill for 22mos is close to $1000. As for snowplowing, they do not plow my area.. just the drive down the whole unit.. i have photos showing my unit is not plowed and that i use my own plow truck...

i asked the secretary about the issues and was told the new leases have the percentages and they obviously made a mistake with mine so i need to follow the new leases.. i say baloney! i follow what i signed.

with these issues, has the landlord broken the lease? can they withhold the security deposit? with 2 months to go, i am debating whether or not to pay the next months' rent (burn up the security deposit) and then let them evict.. i dont care since i am moving out of state..

any advice is appreciated and please remember this is a commercial property not a residential one.
