Hello, We recently sold our property at the island and we always wanted to own a property along the inter -coastal waterway. We are currently living in So California and we visit Oak Island, NC at least once a year and would like to find another property to stay during our vacation. We prefer to purchase a waterfront (Inter coastal) lot and build a home but we are not ready to build a large home until we retire, approx., 3-5 yrs from today.


Our plan is to build a small beach cottage like (approximately 400 sq ft) on stilts and deck towards the rear of the property. Once we are ready to retire, we will build our primary home in front of the cottage and eventually connect the decks between the beach cottage and main house.


Is there a minimum sq footage for a residential home\beach cottage?
Are there any building codes that I should be aware of ?

Within the Town of Oak Island, here is the office that issues building permits:
The Town of Oak Island North Carolina > Departments > Development Services

The Town has building codes. I do not see any minimum square feet as long as it meets building codes. An HOA might have minimum square feet requirements. But here is what the Town requires: https://www.municode.com/library/nc/...COOR_CH8BUBURE

You really need to call the Town of Oak Island and ask the building inspector if your plan is feasible undef the Town's ordinances. My guess is that it is, but the only opinion that counts is the Town's building inspector.

Agree that the OP should contact the building inspector. I thought the plan was a good idea, but I am wary the the 400 SF structure would be treated like an accessory apartment once they apply to build the main structure. Does the zoning on the lot allow accessory apartments?

Thats a good point. Generally speaking, accessory structures are allowed, but they require a conditional use permit. However, that raises another issue, which is, one can't construct an accessory structure prior to constructing the primary structure, so that may make this impossible.

Many place only allow one primary residence. How that is defined may be up to interpretation. You may be able to build a garage first, put an apartment above it and add the primary residence later.
