My boss owns a house in Clinton, CT. The original mortgage company is based in California. In 2010, he refinanced the property, an paid the original loan, however, the original mortgage company did not file a release of the lien and satisfaction of the mortgage. He is trying to renew his loan with the current bank, and they will not renew it until he obtains those documents.

Can someone tell me what documents need to be filed, and where I can obtain them?

His current bank should be able to help him exactly which documents he needs. Why would he ask an employee to come to a public forum to ask for help in obtaining specific documents for a legal transaction. That is just silly. Besides if the current bank is truly the one holding the mortage because of the refinance the current bank should already have all necessary documents.

The bank does not necessarily file a release of mortgage. When you pay off a mortgage note, the lender will send the borrower the release and other paperwork indicating that the loan has been paid. Then the borrower takes the paperwork to town hall and files it himself and pays the nominal filing fee. Once that loan is paid, the lender has no other interest in it.

Have your boss look through his paperwork to see if he has the release of mortgage. It's probably sitting there somewhere and he does not even recognize it. Take it to the town clerk's office, have it date stamped, get the volume and page it will be filed under. It will be mailed back to your boss when the town clerk is finished recording it. Make he he keeps it someplace safe.

Call the closing attorney he used. It may have arrived to the attorneys office and they just filed it away, thinking it was their copy.
