In regards to Hooters, EEOC tried to make Hooters hire male servers. Top management came out wearing Hooters Girl outfits and showed the EEOC what it would look like, EEOC backed down.

You're allowed to discriminate on appearance if it pertains to the job, like nobody has to hire a fat stripper but where A&F screwed up is that they told this girl that she wasn't hired specifically because her head scarf didn't fit the dress code.

Except the law disagrees. You can't discriminate on the basis of religion which A&F openly admitted to doing. The Supreme Court just reaffirmed that as "our policy."

Title VII of the Civil Rights Act of 1964 prohibits employers from discriminating against individuals because of their religion (or lack of religious belief) in hiring, firing, or any other terms and conditions of employment. The law also prohibits job segregation based on religion, such as assigning an employee to a non-customer contact position because of actual or feared customer preference.
In addition, the Act requires employers to reasonably accommodate the religious beliefs and practices of applicants and employees, unless doing so would cause more than a minimal burden on the operation of the employer's business.A reasonable religious accommodation is any adjustment to the work environment that will allow the employee to practice his religion.

The policy of America is that you can't discriminate in employment based on religion. That is the law.

Congratulations, I did not realize that you have been anointed the spokesperson for the United States of America, and that "our policies" apparently contravene our laws. How does that work?

If the plaintiff in this case listened to you, she would be required to go back to Oklahoma, where she was born. What do they say about assumptions?

I agree with the court's decision and hope that A&F learned something, but they will probably just start giving reasons like, "She's not perky enough" or "Just not a good personality fit." All they probably learned is not to admit when you're doing something illegal.

Good post.
I think it's apparent that Juram was playing along with the joke that nightcrawler was pretending to be a misinformed neocon in order to make them look like idiots
