Your incorrect about who she sued. She sued the child who was 8 years old when the incident supposedly happened. She did NOT sue anyone's insurance company nor did she sue any adult!

The jury threw her case out. They didn't buy her nonsense. She asked for a marshall escort to leave the building. She has refused to speak to any media as well.
In Connecticut, you sue the "Person" not the insurance company, If the person has insurance coverage (or covered under someone elses) , they will represent you, and fight/pay the suit/judgement.

I'd like to know how this woman racked up over $100K in medical bills for a broken wrist. Did the kid completely crush it so it required reconstructive surgery, or maybe a whole new-arm transplant? Sounds like there are some doctors somewhere laughing all the way to the bank.
I had a broken ankle several years ago, spent 6 weeks in a cast & on crutches. It healed fine & was back to work after the 7th week. Total cost to the insurance company was $3,500.00.
I guess I got a bargain.

How is it that a broken wrist would cost anyone $127,500 even without health insurance? And it sounds as if she DOES have health insurance.

Her health insurance refused to pay on the grounds that the injury occurred on someone else's property as a result of an interaction with someone who resided on the property. She filed a claim with her cousin's home owner's insurance and they denied it. You can not sue an insurance company for refusing to pay a claim in her state. She couldn't sue her own Health insurance company or her cousin's homeowner carrier. You must sue the person who caused the injury. If the person who caused the injury was liable then the insurance company would have been required by state law to pay the amount awarded in the lawsuit OR the maximum of the policy. She had 4 surgeries and hundreds of hours of physical therapy. 120k of med bills doesn't seem that high to me with the cost of health care today. Her lawyer made it clear that she was only trying to get her medical bills paid. She wanted no money directly from her cousin. They were trying to force the insurance company to pay. The cousin, BTW, fully supports her. He testified on her behalf and parted ways with the insurance company after they refused to pay.

There is absolutely no mention about any insurance company in any article I've read. Everything I've read (and I've read at least 6 articles) says she is suing the child....suing a minor doesn't usually work out well anyway. No mention of any insurance company representing the young fellow either. Poor kid must be so traumatized now.....nice aunt!
