A Wisconsin law that requires abortion providers to get admitting privileges at nearby hospitals is unconstitutional, a federal appeals court panel ruled Monday.
Federal court rules Wisconsin abortion law unconstitutional - LA Times

Quote:
Judge Richard Posner, writing for the 7th Circuit majority, stated that the regulation qualifies as an "undue burden" and that the medical grounds for such a requirement is "nonexistent." Posner also had some words for abortion foes: "Opponents of abortion reveal their true objectives when they procure legislation limited to a medical procedure— abortion—that rarely produces a medical emergency."

In anticipation of the incipient chorus of whines about 'activist liberal judges!', I'd like to remind (or educate) the knee-jerk crowd that Judge Richard Posner was nominated in 1981 by President Ronald Reagan and confirmed by the Republican-controlled Senate that same year.

The decision:

Yeah, people sometimes forget that just because they don't like a law doesn't mean that makes it unconstitutional.

Well, to be fair, Judge Posner has become more of a liberal in the recent years. However, hands down, he is the most respected Federal judge outside of the SCOTUS, and the SCOTUS will pay attention to what he has to say on any topic. The admitting privilege requirement is totally bogus, and the SCOTUS will rule on it in the Texas case that they granted a writ of certiorari on recently.

Anti-choice people should realize that the more you cut off access to traditional abortions, the more people will rely on other methods, i.e., abortion pills purchased online. These pills, purchased often from foreign sources, are not prescribed under physicians' oversight, and the quality control and purity are questionable. Currently, third trimester abortion simply cannot be obtained (except for limited medical reasons). However, with abortion pills, no one can exercise any type of control whatsoever. By making the process a lot easier (e.g., not having to walk through the abusing line at Planned Parenthood), there will be more abortions. Also, more patients will get an abortion in Mexico and elsewhere.

Watch out what you wish for; you could lose all control over the procedure.
