This actually happens a lot. I know a man who had just beaten an aggressive form of cancer, got great news at the doctors office. 2 days later walking down a street in the evening with his wife and a huge branch fell on him killing him immediately.
In 1984, a guy went jogging during a storm with high winds. He was passing through an affluent area when an oak tree fell on him, rendering him a paraplegic. He sued. The settlement was for $10 million.
Now he's the Governor of Texas.
He probably won due to the neglect of maintaining the trees of the neighborhood....

Because if trees are properly 'maintained', they don't blow over!

...which is why I spent $3K to have my maple examined by an arborist, and carefully pruned. It's 75+ years old. They felled a Lodgepole Pine in my yard that was making me nervous, too. Seattle has weird windstorms every once in awhile, notably c. 2007 when the area was paralyzed (bad pun) due to downed power lines after such a storm late in the season.
All I need is dead people under my damn maple. Thank God for umbrella insurance policies, too.

I had an arborist come inspect the trees on my property in March. Several dead limbs were removed, and some dead trees, too.
A few weeks ago (July) a huge limb from one of my trees suddenly fell down in the middle of the night. It squashed a section of fence, but nothing else, thankfully. This was a very healthy looking limb with plenty of leaves from a very healthy looking tree.
Limbs fall. Even experts can't find every possible thing that might happen. People should stop suing each other.
Those branches are called widow makers. You learn to be very cautious of them if you spend any time camping. It's one of the first rules of setting up a campsite. Look up!
So tragic. Those poor little kids. I wonder if the family will file a wrongful death law suit.
