I had the opportunity to try Chipolte and found it to be very good. I know some will always be dissing them (Like I do with Nike and other corps) but they simply dropped the ball and paid a price for that and now are trying to repair the damage (But to some) it never will be.
(In regards to Nike, I worked for them. That's enough reason to dislike them )
I think she knows she got the E. coli from a different source and sued Chipotle because they have deep pockets. She could have easily gotten it from any number of vectors, including improper food preparation in her own kitchen. Perhaps she was in a hurry, prepared undercooked hamburger at home, ate at Chipotle soon afterward, then blamed them for her illness. Cha-ching!
It's very difficult to locate the exact time and source of food poisoning. People can say, "X caused me food poisoning at Y time," but that's nearly impossible to determine for certain, because people digest food at different rates, we eat many varieties of food, the source of contamination is hard to locate, and stomach problems are vague and can be caused by many different things, including causes not even related to the stomach itself.
My daughter got salmonella several years ago, and when she was diagnosed the Health Department called me because our doctor was required to report it. They asked where she'd been, where she ate, what she ate, etc., so they could track it with any other reports to help pinpoint the source. Isn't e. Coli the same? If you're going to win a lawsuit against a corporation, it seems like you'd need at least a little evidence. Otherwise why aren't there droves of people suing and winning every time they get diarrhea?

Yeah very much so. If you come down with any type of "food poisoning" and believe it is not from your own error, report it. My kid's got food poisoning from sushi from the grocery store (where they cut it fresh). I called it in. It was taken very seriously and they went right out to check the case and found part of the case wasn't staying cold enough. All the fish was tossed out and the refrigeration was repaired. People can die from that! My kids were lucky...they still haven't wanted sushi from a grocery store since.
P.S. we didn't sue...but we wouldn't have really had a case without more evidence anyways. You would have to have it be a confirmed source to sue. I wouldn't have sued anyways
