There are attorneys who specialize in cycling-related accidents. Laws (or lack thereof) protecting non-car traffic vary from state to state. I am in SC where best resource for injured cyclists is mybikelaw.com ... might be a good starting point for you to find someone similar in your area.

This is something that you should talk to a lawyer about. Anonymous opinions off the internet are worth what you pay for them. Although you might ask on your local area forum for good personal injury lawyers. I realize you must have started there and this thread got moved. Maybe just rephrase the question and start another. Or as someone mentioned go thru the yellow pages.

Still, a piece of styrofoam is not going to do much to protect against a car.

I say not much since you are too stupid to wear a helmet.

Oh, and "out of nowhere". When you go buy the helmet take a course in observational driving (works for riding). If they came "out of nowhere" you weren't paying enough attention and probably shouldn't be allowed to ride a bike or drive a car.

I settled for way to little when I had this happen. I had a lot more injuries than I originally thought. Get an Attorney if you are sure it was the drivers fault. My medical bills ended up being nearly 300,000 before all surgeries were over. The difference between his insurance and yours paying will be quite a bit in deductable.
