Hello,

I had a neighbors home bought back because of severe foundation issues (big surprise with all the horrible builders). They fixed the house...it's sitting on about 20 plus piers. They put lipstick on the pig (refinished floors, fixed cabinets and painted). Is it true that there is a loop hole for builder and they DON'T have to disclose the foundation being fixed? I had a realtor look when it was on the market and the disclosure did not say a word but they added a LONG foundation report and the fix was buried like 20pages deep. I don't think the couple knows...now they are building a side addition and don't even know that will void their warranty (well...I guess they don't know they have one). This just seems SOOOOOOO wrong on many levels. Fill an east coat girl in on the laws in TX.

You said they provided a report. They don't have to bullet point the report. If they did, it would add another 10 pages (exaggeration) and what makes you think they would read that any more closely then the actual report? You say they aren't disclosing it, but providing such a report is signalling they should read it as it's an addition to the basic disclosure. Also, the notice states to attach any inspections that have been done, and that's what they're doing. Not sure why you think they're doing anything wrong.

Any addition, even if it was still under a basic builder warranty from being brand new, would be voided if an addition was added, so the new owners aren't voiding anything that wouldn't have already been voided upon wanting more space.

I am curious where it was and which builder, as I have had 2 realtors in the last few months mention a certain area and builder that was buying back homes due to foundation issues.
