I own a KB town home in Colorado, we are the second owner, and if I would have known what I know now we would never have bought this thing. Our HOA is currently in litigation with KB due to construction defects across our Sub-division. They range from simple things like corner strips and counter tops pulling away from walls, to major things like flashing installed wrong, windows incorrectly installed, missing insulation and missing vapor barriers on the exterior of the home. These are things that are hard to notice unless there is a visual sign that causes some further investigation. For our HOA it was some surface mold growing on the siding of one of the buildings that started it all. The HOA found someone to look at the mold and find where it was coming from, they started to pull apart the siding and found the missing vapor barrier. This started the whole chain of events. Since then KB has been given the chance to come repair the damage along with all of the items found to be installed incorrectly, or missing. They have declined the offer, and has forced our HOA to sue them to get the repairs done. This is not the first time they have been brought to litigation either. There is at least one other sub-division within Colorado that has brought them to court, along with many sub-divisions around the nation, one in texas found live rounds and unexploded ordinance in their lots due to the lack of cleaning of an ex military ordinance training range.

Sounds like a real mess. Live ammo found on building lots is not the fault of the builder but the developer. Developers are the ones that buy the land, do the grading, install, the utilities and streets to county specs, and then sell the lots to the builders.

Sure dude -- because those bombs never showed up while they were digging the foundations.

KB is a **** builder and they have proven this over and over and over.

Had the same thing back in DC, in an exclusive area of NW DC near American University. Lots of shells filled with mustard gas. The USA Corps of Engineers came in and excavated to remove about 8000 items of ordnance and haul it away. That would be the Spring Valley area. The clean up went from 1998-2002. During WW-1 the university had been a weapons research facility. It's amazing what's laying around out there. Imagine your six year old walking into the kitchen with one of those shells.
