Ok, you all know I did not support Obama during the election. With that being said, I think it is time to move past the "Was Obama born in the US" thing. However, this Democratic attorney, Berg, does not agree. He is taking his case to the Supreme court. He expects it will be heard.
Now having been someone who has studied numerous past supreme court cases over the years, I know their first review is the past court cases that brought it to them, the supreme court. They typically look at the path that brought it to them first. Seeing as how the 3 lower courts dismissed the suits, do you believe the supreme court will do the same? My guess is they will. So where does this all lead? (whisper here) what if they don't?
And just what evidence does this guy claim he has? Hawaii has already said they viewed the documents and they are authentic. So in order for the Supreme Court to review the case he needs some sort of evidence to supercede the Hawaii credentials. Does he have it? Does he have anything? What is his major assertion of claim?

Evidence isn't going to do the job. The appeal of lower court ruling has to be on the basis of errors in judgment.
Surrick tossed the case due to standing, even with the presumption that all evidence was what Berg said it was.
Further, Berg is claiming New and Improved(tm)evidence, which was not introduced in the earlier trial - and would therefore be inadmissible at this one, even if 4 of them agree to give him a hearing.
So, yeah - the only way he gets his cert, for my money, is if Scalia, Thomas, Alito, and Roberts make that call. I can't see Roberts doing that, given how he has run his court to this point.
Even if he got a hearing, I can't see how he wins without overturning one of the major pillars of court decisions-past. Standing is a huge obstacle.
And... if he wins at the Supreme Court, all that's going to do is send it back down to the lower court, anyway.
I heard they are not asking for any documents from Obama for review so that is a sign.
Well, no.
The issue at hand is not whether Obama was or was not born in the U.S.
The only question is whether the Supreme Court should hear this appeal. So, the Obama team was asked only to respond to the Writ of Certiori request. This requires no proof of anything, other than a renewed claim by the Obama team, with citations, of why Berg has no standing and therefore the dismissal by Judge Surrick should stand.
