have a question. I have a neighbor that cut his tree in a way that it leans more towards my property. He cut off all the big branches on his side so most are hanging on my side and its leaning towards my property.What would happen if a big storm came and his tree would fall on MY HOUSE? Whose insurance will cover or has to cover that?]

Why not ask him why he didn't trim the branches that are on your side??? And then, ask him to do so isf he says he doesn't know! What is the problem with that??? You are building up stress where there really is no need for it, I think.

Take photos of the tree, make sure you get the angle from which the cut was made. Also take photos of your home and property and of the neighbors.

If the tree falls on your property (or house, hope not), take photos of the damage from all angles; tree, roots, house and all.

Then pray for your neighbor, their stupidity will cost them, especially if they don't have insurance of some sort.

This is one mistake they'll never make again, lol.

because my neighbor is an idiot he won't even look at me! that's why. he is very strange.

i am going to take pictures and videos but is his insurance even required to cover damage? i once heard anything that is hanging over my fence line is my responsibility which i have no problem cutting the overhanging branches but that does not solve the problem the tree is still leaning towards my house versus his!

If his tree falls and causes damage to your property, you could first ask him to pay you for the damage, or ask him for the name of his homeowner's insurance and call them to let them know of the damage. If he refuses, you could make a claim against your homeowner's insurance, and most likely your insurance company will seek reimbursement from him.

You, or your insurance company, would be responsible if the tree landed on your house unless you could prove that the tree was dead or dying. The branches hanging over your property are viewed as belonging to you, and you can cut only those branches back to the point that are on your side of the property line. Where sometimes things get fuzzy, however, is if you would cut the tree back so far that it could be proven that this killed the tree..... courts can sometimes find you liable for that cost. This is a very convaluted issue wherever you live.

This has always been my understanding as well...but I have never understood the logic or reasoning behind it. If the tree's trunk is 51% or more on your property, then it should be your tree...and your responsibility to not infringe on other people's property.
