Does anyone know if sending an altered Will through the mail is considered to be a crime in SC? I know some laws vary from state to state.
Thanks.

Isn't altering a legal document with intentions to defraud against the law anyhow, making it a crime of forgery, no matter if it's sent through the mail, or not?

I would think so but I'm not quite sure in this case.

Justia :: Criminal Law 1903. Forgery by Altering or Falsifying Will or Other Legal Document

I would think this would be the case in any state, a legal document cannot be altered if intended to defraud.

I don't know about mailing it, but here is the South Carolina Code of Law that addresses forgery in general (not wills specifically):

South Carolina Legislature Online - Code of Laws Title 16 Chapter 13 Forgery, Larceny, Embezzlement, False Pretenses And Cheats

I did a quick search through the South Carolina Code of Law Probate Code for anything containing "fraud" or "forgery," but the only references I found were to powers of attorney and intestacy (dying without a will), not to forged or altered wills.

You might find something else helpful, though:

South Carolina Legislature Online - Code of Laws Title 62 South Carolina Probate Code

I may have to let this whole thing go. I was told by an attorney that I may risk a Malicious prosecution suit against the --- that did this to me.

Interesting. So I decide to wait until a separate issue is resolved and now I'm told I may be sued for reporting a crime.
