We were at a complete stop(traffic suddenly came to a halt due to a car infront) when a commercial truck driver rear-ended us, causing our prius to be totaled. I was driving, and escaped unhurt. My wife and 4 yr child were sitting behind. Wife had a couple of stiches(emergency room) and my daughter escaped unhurt.

My wife's vertigo problem has come back because of the accident.

What is a reasonable settlement amount to expect? They are offering $5000 and value of the car.

If you can afford to go ten years, do so. Get a lawyer and settle in for the long haul. Forget about the case and move on with your life. See, with the insurance company, it is all about the company picnic. If they can get you to settle for five thousand, they will have a lot to party and cheer about.

Insurance agent? The best thing to do is wait it out. They use the tactic of drawing out the process so that perhaps the victim is willing to accept a low ball figure. I am so glad you guys are ok. That must have been very scary for all of you!

I am not one to be lawyer happy, but that figure seems awfully low to me. I would get a lawyer.

Indeed, get a lawyer, but then be prepared to forget about it. People accepting low ball figures in tese cases helps create a lot of stupid truck drivers.

Greed, money, settlements will find a way to get you back so just count your blessing and step away from the "reasonable settlement" or the intent. This is exactly what's wrong with this country, the wind blows and we ask for a "reasonable settlement". Let's get a lawyer and make us some money... Sorry, I just had to do it mate, but the whole idea of asking for free money is absolutely disgusting. And vertigo coming back because of the accident? C'mon :-) I have someone in my family with vertigo and I know better.

And yes I was in a wreck with a teenager too busy texting. Head on collision. Her car was totaled and so was mine. She was actually at fault and also hurt pretty bad. And my immediate priority wasn't how to get a lawyer and make some money even thou I was pretty banged up. I had my car replaced and that was about it. And she does have some long term, life long damage which really sucks because she was so young.

I am glad that everyone is alive, it could have been worse. An accident is not a blank check of course, but I also feel that if you were not at fault, and there could be long term effects, then the compensation should reflect that. I'm the last one to encourage anyone to file a lawsuit, but you should not shortchange yourself either. 5K sounds rather low to me, but they are crossing their fingers and giggling right now hoping that you accept, it is a standard practice.

In cases like this, I would not ever trust an insurance company to do the right thing, I don't care who it is. They are not in the business of giving away money, and the money they do so is done with what seems like compassion, but the truth is that it is a for-profit business, and they have business models, and their agents are expertly trained not only to avoid paying out too much, but they've also been coached on how to deny you what's due in a nice, compassionate way. The amount that an agent pays out over a period is used in their pay, and merit payouts, so even the agent knows this and will still to a formula.

Speak to an attorney, and look at the long term picture and request an honest amount, but don't be greedy, it is not a lottery.
