Gotta imagine as long as it's replaced properly it shouldn't be an issue.

I believe our hoa has similar verbage, but that didn't prevent AT and T from tearing up sidewalks when they ran their fiber.

I know a guy that bought a house several years ago with the same problem. He didn't catch it prior to closing on the house and moving in. When he brought his corvette over, he couldn't get it in the driveway. He had to rent a mini storage while he sold the house. In the end, he kept the vette, sold the house and bought another house without a jacked up driveway.

Personally, I would move on and find another house because the city of Madison is a pain in the ass to deal with and the likelihood of getting anywhere with them is between slim and none.

House might not ever sell then. If I was the seller I would try to fix the problem.

The community builder's official response is for me to pound sand. They had the sidewalks poured to meet new ADA standards that mandated sidewalks have a 0-2% cross slope. (Of course they chose 0%) Unfortunately, they put the sidewalk very close to the curb forcing the connecting apron to be steep. Their poor planning has ruled out this community for anyone that drives any low slung sports car.

Unless I can get the city to round off that driveway which is looking less likely, then this whole thing is dead.

What neighborhood?

One of my neighbors had a similar problem with a house he was building, but caught it prior to closing and they re-poured the section to minimize the slope.

They do have temporary ramps you can buy on Amazon to fill the gap, but that would be a PITA to put down all the time.

Hilltop Ridge just north of the Browns Ferry and Burgreen intersection.

Was your neighbor's home in the Madison city limits?

That's because its a utilities and drainage easement, which trumps anything stated in the CCRs. Ultimately the city/county controls it.

Sidewalks are the citys to maintain. All public sidewalks in the city are either in the ROW or in a pedestrian access easement.
