which states aliens cant be held more
than 6 months past final deportation order
most are released after 90 day review
Delay could be refusal of consulate delay
in issuing a travel document or refusal to issue travel
document if alien cant prove citizenship

No US Supreme Court has ruled on it post deportation order
ICE can only hold you for 6 months aliens can file habeas
corpus for release from US District Court if detention is more
than 6 months

I know that. But, that wasn't the reason given for his release. According to the article, ICE released him because he was not deemed a risk.

so ICE prob tried to deport him but couldnt
Flight risk is based on past record so if he had no

That is pure speculation. There is nothing in this article to indicate that ICE was ever unable to deport him. He was ordered deported, but true to form, ICE failed to follow through. Nor does it mention whether he had previously skipped bail, or had outstanding warrants. His history of child molestation alone should have been reason enough to consider him a "risk."

In case you don't know, illegal alien absconders are routinely ignored by ICE. In fact, Obama's illegal alien aunt and uncle were both ordered deported, ignored those orders, and are now living here as free as birds. To add insult to injury, his aunt is receiving tax-funded food stamps and disability, which she will likely receive for the remainder of her parasitic life. And, they are here not because their countries refused their return, and they therefore had to be released in accordance with the law. They are here because our enforcement is a joke and ICE is inept.

And how often do we hear judges state facts such as, we let this villan go, or go earlier then expected, because she or he did not look the part. Way too often.
Criminals don't always wear a guilty look.

"Post deportation order" (once an order of deportation is signed and filed) up to 6 months, then bond hearing as long as immigrant has appeal on case, otherwise if flight risk or danger to community, really no time limit.

and then the ruling goes on to state this little gem

The above is for "legal immigrants", it wasn't until Clark v Martinez (2005) when it was expanded to cover "arriving aliens" seeking to enter, not illegal aliens found within the boundaries having bypassed immigration officials.
