Hey everyone I am looking for some help from someone who has been through this process before or can lend some advice my way.

STORY

My mother decided to buy a new house a couple years ago and sell her old home that is owned outright. The market wasn't doing well, and she didn't get any buyers. Eventually a long time friend of hers verbally agreed to move in the old house and pay her $600 / month for rent. No lease was signed and the utilities remained in my mom's name.

The market has recovered a bit and she decided to put the house back on the market. She notified her tenant in August, and he has not paid any rent since that day. He has been very nasty to my mother, and has stopped paying her for the utilities that are in her name.

She was not prepared for this and we have no idea how to legally go about getting this guy out of her home. She is very distraught over the whole situation because she lost a close friend, and I would like to help her get this figured out..

I agree. Go have a discussion with an attorney and ask what your options are. The sooner the better.

Why couldn't she just call the police and have the former friend removed for trespassing? I'd sure try to avoid an attorney at all costs, plus it's very difficult to gte an attorney to take a case that won't bring in a big payout.

You could also go to a legal website like Legal Zoom and dig around to see what your options might be, even find some form letters for an eviction order.

You don't necessarily need an attorney to "take the case", you can just pay for an hour or two of their time to explain the situation and have them tell you the options and risks involved. These days it can be risky trying to evict someone without opening yourself up to the possibility of a lawsuit afterwards.

This is your only option. They will now have all the rights and you will have to fight to evict them lease or not. Sounds like they already know this. I would act very fast as it could take many months to properly and lawfully evict them.

I still have a rental home in KC and if my tenant is ever a week late on rent, I will start an eviction process and then once they are out, I will sell the house because I'm only renting out the house till the market gets better. Heard way too many horror stories.

If the OP will glance around the "Renting" subforum on the "Real Estate" forum here, they will find that you better know what you're doing when you start evicting people, with a lease or not. This isn't a "big payout" type case. This is where you pay a lawyer by the hour for their expertise.
