Yesterday I had a chance to visit a Open house in Hicksville border with Jericho. The agent tells me the corner of the backyard touches Jericho and by law the owner can choose the school district.
Has anyone heard of this? On nassau property it show Hicksville. I do think the house is overprice. Just wondering about this.
Why don't you just call the school district and ask if that house is in their district?
But yes, I do believe that in certain cases if you are on the border of a district you can choose to go to those schools. I'm not sure if the criteria is "the backyard touching the border" so you should call and check.
When a property was in two school school districts, it had been that the original owner made a permanent election, binding all future property owners, of which school district the property would be located in.
Within the last 25 years, or so, this was changed by the legislature so that each time a property is sold, the new owner can make a one-time election of which of the 2 school districts the property will be located in.
Doesnt the school district you are leaving have to give permission for you to switch( i.e. provide official documentation "releasing you" from the SD)?

Spoke to the Jericho SD and they said they would only accept the change over if they got a formal letter from Hicksville. She said that the letter is at the discretion of Hicksville.

Whoever you spoke to at the Jericho Union Free School District may have misspoke as that letter designating a change in school district where a property is located most probably would come from the Office of the Town Clerk of the Town of Oyster Bay.
