My friend is in TOB, and was told she needs 20' from the fence and 10' from the house to accommodate an IGP for a house she's looking to buy. The real estate agent told her to apply for a variance since the property doesn't allow for it. Further, said agent said that if the town rejects it, she can get a state variance. Is this true? I don't have a pool so idk what TOB is like reools. This sounded pretty sketchy to me.

Variances extremely easy to obtain they can be done by an expedited if you wish it is something that is very common and unless you're asking for something extremely bizarre most likely will get the varianceThe state variances baloney I'm in the pool business

Thanks a lot. So even if she doesn't have that distance as required, you think Brookhaven will allow it? Do you guys expedite the variances? I'm completely ignorant on this topic. Thanks again.

its a big deal. Suggest the RE agentor owner handle it and see their reaction. Only the Town can answer your friends questions. No such thing as a state variance. if there where why would you need a town one?
