I move into a basement apartment in Suffolk county under the assumption it was the owner who was renting the place on craigslist. Anyway after about 2 months they told me that they had been evicted and i had to leave, meaning that they had rented in order to collect security deposit in their next place. I had no written agreement and recieved damages to property now the guy who i guess subletted to me is now trying to sue me in small claims court for last months rent. I had left and found another place. Need feed back on situation. The actual owner of property is NOT suing me i dont think he even new i was there.

I am going to guess it is an illegal apartment to begin with. If anything, you might have a suit against him! I wouldn't lose sleep over it.

The first thing the judge will do is to demand to see a lease. If there is no lease, then it gets trickier to get a judgement.
Get proof that they are not the owners of the property.

If they were renting the house, it would be possible, but extremely unusual, that they had the right to sublet. They are going to have to prove that they had the legal right to sublet. Again, it's extremely doubtful that this is the case.
