I got a ticket from the City of LA for parking over the time limit, which I didn't. After an Administrative Review, they upheld their decision. I then paid the ticket and penalties late. I want to know if I can sue the City since I believe the ticket was given to me in error?

Sure, you can sue. You'll pay more than the ticket in court costs and lose, but have at it.

There is no way to prove that you didn't go over the limit and there is no way they are going to side with you over the City of LA.

Is it worth your time and effort?

Go ahead and sue and let us know the out-come. Since we are such a ligitous society, you may want to consult with an attorney.

I don't think so. If you paid the ticket, you've probably closed the window on the appeals process. The problem with suing -- or more probably, filing an appeal -- is that you are now the "moving party" (the one making an allegation) and so the burden of proof is now on you. As other posters have pointed out, you really can't prove, by way of substantial evidence, that the citation was issued in error. You can only stake the claim that that was the case and demand the City to prove otherwise. That won't be sufficient. The City would effectively enjoy presumed innocence of erring in their assignment of the citation.

The "city" is part of the Government....nobody beats the government, the government does the beating. You already lost the lawsuit.

Excuse me ! but you can fight city hall and win as i did . As for the ticket it is finished you paid the fine case closed , you admitted guilt . Now the next time if there is one no matter what DEMAND a verified complaint on their claim or ticket ( see my many post on that subject) when done as i have instructed you win every time no matter what . It is all about c.p.c.853.9 ( California Penal codes ) and Vehicle code 40513, your right to a verified complaint WHEN you demand it ! and only if you demand it at your arraignment.
