Well, if he didn't pay the ticket, he would be fined even more penalties. He could have paid under protest. At any rate, all he wants is his due process; an appeal. That could be carried out in different ways. As far as I know (which isn't much) he can take a municipality to Small Claims Court.

But, he better have a bullet prove case.

He needs to forget this whole crazy thing, sueing over a parking ticket and what would be gained? There is no way he could win this one. That is all the courts need is one more stupid law suit to back them up even further.

I got a ticket like that once in the Wilshire district. The sign said no more than 2 hours parking. I was there for 45 minutes and got a ticket for going over the limit. I went to the hearing with a witness and still lost. You can't beat a parking ticket in this town. I filed everything in time, so there was no additional penalties.

Default Parking tickets

I got 2 parking tickets for parking on a street that was being street cleaned. They are identical tickets given by two different officers within an hour of each other. The vehicle was not moved in between tickets. I appealed the second ticket arguing it was a redundant citation given in error - I lost the administrative review and appeal. Do I have any recourse? Thanx

That is double jeopardy. Being punished twice for the same offence. A violation of your consitutional rights.

Fifth Amendment to the United States Constitution - Wikipedia, the free encyclopedia

I don't know how to fight it though.

This is a joke, right? You honestly want to sue for that? There is something very wrong in our country.... People sue for ANYTHING.
