I think a lot of it has to do with the purpose of the HOA. If it is to improve conditions the homeowners don't like such as bad roads, or something they want such as a community swimming pool, and IF the HOA is low, there probably won't be a lot of resistance. But, if you tell someone they can't paint their house black then you will have push back. If it only applies to future homes not yet built, or potential new owners of presently occupied homes, it might fly.

In the meantime, before you spend a lot of money, do consult a good real estate lawyer. He should know something about HOA as it applies to LA law.
