I am about to go through a divorce and have an 8 month old daughter(tried fixing it). I am currently an A1C and talked with my shirt and i will still live off base in my apt after the divorce is finalized...my question is what kind of child rights would i have to get to be able to qualify for my BAH with dependent? Would i have to legally have my daughter live with me or is there some kind of rights that I could fight for in court? I don't know how to find info. on this subject..i've tried for days.

I looked into about.com, it appears if you have custody or have to pay some sort of child support that you get the full rate. I think at your rank it's only like $150/mo different between with and without dependent.

I'm in San Antonio and I currently get 1139 but without dependents its 854. AND my rent is 1052..That's the reason i'm hoping to still get the full BAH

If you have joint custody you will get full BAH. Whatever you do consult a lawyer and get everything you and your wife agree to in black and white. You will pay for a lawyer now, but it will be cheaper than having to pay for one later if things go south. I know too many that separated with verbal agreements that quickly fall apart, especially where a child is involved.
You do get full BAH as has been mentioned before. You'll also have to clarify what will happen if you either get called into work or get deployed as a single parent. Make solid plans and try to get the most predictable schedule as possible - there will be emergencies (example: sick children usually aren't accepted into day care).
