What is the smartest and less costly approach...i've gone through my retirement fund paying this mortgage. Loan mortgage is still in my deceased fiances' name "the estate of .."I'm on the grant deed as joint tenant..BUT NOT ON THE MORTGAGE LOAN.I owe 144250 on the mortgage debt...the house is upside down..valued @ 125000 approx. a] bank will only allow me to refinance @ about 35000...then assume the loan b] short sale c] foreclose ...quit paying on the loan...i have apts i'm selling now ...when & if they sell i could either buy another house for less...as i have lost my ability to pay this mortgage @ this point .THIS IS SCARY...AS I'M @ RETIREMENT AGE... .PS probate closed in2008...skRobinson

Are you obligated to make payments or are you just doing it to prevent foreclosure?

There is no such thing as retirement age.

Lots of people post on here about refinancing or doing some
other thing with a huge mortgage so that they can retire.

There was a time that people actually planned for retirement and part
of the plan was to be debt-free. I don't know what happened to that.

If probate closed in 2008, why wasn't the deed changed? Are you on the deed as joint with someone other than your fiance? Who owns the other half?
