Hi I was living as a tenant on a property in Bayonne, NJ for around 5 and half years.
we paid one and half month security.

in Dec 2016 we moved to our own home.
But Owner returned only $320.95, out of $2625 and didn't return $2305.
he gave me a expense list after around 35 days where he is cutting money for white wash, carpet cleaning, small hole in door that was because one side of door stopper was keeping hitting the door for 6 years.
so everything is like pure wear and tear.
we always paid on time.

I was wondering should I claim in court(hudson county), what are pros and cons.
does return of security and/or expense list is strictly 30 days.

Thanks in advance.

I think that amount would qualify for small claims court.

Speaking as a landlord, I'm on your side. If a tenant lives in an apartment for five years, I have no right to withhold for repainting or carpet cleaning (unless you have completely destroyed the place, which thankfully has never happened to me). I also wouldn't hold you responsible for the wall damage. Good luck!

Hudson - Special Civil Part

"Small Claims matters are limited to actions in which a plaintiff seeks to collect a sum of money, not to exceed $3,000. In actions for the recovery of Security Deposits the monetary limit is $5,000. "
