I am trying to reopen a unemployment claim. I had started working and was let go after a month and half. The company policy was no use of cell phones on the floor. I had asked my supervisor if I could have my phone on me because I am a diabetic and was waiting on important information from my doctor and my health provider. He had told me that it was ok, that when I got any calls to take it out to the lunch room. When I was asked by another employee what time it was I looked and noticed that I had missed a call. Just them he walked up behind me and started yelling at me. He wrote me up and then came back and told me that I was fired. When I got the call from unemployment I told them what had happened and they told me they were going to call the employer and if there was any difference in what happened they would call me back that afternoon. They called my back 5 days later while I was in the shower and left a message telling that the stories did not match at all and that because I did not answer to make a rebuttle they would make the decision for the case without speaking to me. I have been trying to get a hold of them and have been on the phone waiting for over an hour. How can they try once and then just say that I am not interested in making a rebuttle and therefore make a decision without talking to me. Does NJ always do this. Its like I have no voice and if they were going to take the employers side why do they even bother with this process at all.
