I just ended my previous lease on 7/31/23 (3 days ago) and was in the running for the Ruby Lottery with CB priority.

Does anyone know if my CB priority be voided because I am no longer living in this unit? When I applied I was living there.

probably, but it depends on how far you are in the document process. You might be able to get by if you submitted everything already.

They won't know unless you tell them. I was reached out for another lottery apartment right after I moved that I was in CB for but I moved just across the CB line and still got to tour. almost all my paperwork had the old address and it was not an issue. So if the address is not updated on your statements it might be fine. But I think technically it is supposed to be voided.

Obtaining a "tour" is not same as paperwork being sent to HPD for final approval however. From what one has read on this forum people go for tours of units all the time, then only not to get said apartment in question nor any other.

Basically everything seems in play up until and or until a lease is drawn up to be signed.

Developers or agent handling lottery process and city know much can change with an applicant before their lottery number is called and process begins. More still can change as that process drags out. If things go on long enough fresh set of documents may be requested.

True, but in my case, it had been reviewed by a 3rd party and was ready to send to HPD and they do not send generally unless they think it will get approved. But it could still have gotten denied.

Marketing handbook says: "As instructed by the Agency prior to the marketing effort, the Marketing Agent may be required during initial lease-up or sales to give an occupancy preference for a percentage of the units to applicants who, at the time of application and processing, are residents of the Community District in which the building is located (“Community Preference Units”)"

Two key words there are "application" and "processing"

It may be that as your application moves forward through processing no further questions will be asked about current address. Or, then again agent or HPD may indeed ask indirectly or directly if there has been a change of address/do you still live within CB.

Best advice is to say nothing but don't lie. If they ask then you should obviously tell the truth. OTOH if issue isn't brought up....

Appreciate your response. I let them know that I moved out, which maybe wasn't a good idea. But, to your point, I think they would've found out one way or another. What a dumb reason to not get selected for this apartment. I applied back in February - how can they expect me to re-sign a lease if I am expecting to qualify for the lottery within the month?

I think that’s why many applications are eligible by the time they are contacted. Not only this, income/ household changes too. I hope this won’t be an issue for you since you literally just moved out and you’re in the middle of the process (also we can keep all cb going so they can start gp soon lol)

Lol maybe I should sublet the cheapest apartment from someone in the CB for one month to qualify
