Jcoltrane, i'm over 18.

You say

Sixth, every year those receiving Medicaid must re-certify their eligibility. Usually, to my knowledge, a simple form is sent to recipients that must be completed and returned. Most importantly, the form MUST be returned by a certain date. If the form is late, or a recipient neglects to return the form. Their Medicaid is terminated.

Yes that is what my parents told me. But the thing was this year the letter just recertified me and my sister automatically and we had to contact them back that i wasn't eligible. They told me previous years they had to always sign up for use themselves.

And I did not see this letter till March 2011 so i thought i was screwed since letter was dated December 2010 and i had to tell them by January or so.

By the way, do i must have health insurance if i'm self employed?

hey I'm currently in the process of filing my taxes but i will call my health insurance company afterwards. I have an accountant doing it and he is still in the process.

Someone tells me i can't talk to my health insurance company until i have the tax forms to prove that i wasn't eligible for the health first medicaid. Do you know if this is true or not?

Also, some people have told me its best to get legal advice first before contacting health first because something like this is pretty serious. Because i do plan to call them up within the next week but that is only after my accountant files my taxes first and he is still working on my taxes. A person who works at the health first offices i spoke to who only does signup told me i can't call healthfirst medicaid office and tell them about this until i prove i wasn't eligible which would only be after i show them the tax returns.

The thing is i know you said just call them and tell them i wasn't eligible and all i have to do is repay what i owe which is perfectly fine. But few people told me i can get in serious legal trouble for this and its best to talk to a lawyer first. Would you think this is the smart thing to do first before visiting the medicaid office?? I know being honest is the best thing but if i tell them and they did see it as fraud b/c i did use it to see specialists earlier this year, some people told me i used it when i knew i wasn't eligible. This is of course when i haven't filed my taxes yet which did made me eligible.

Should i get some legal advice first before contacting the main medicare health first office first?

Thank you.
