I applied for unemployment, received two weeks of pay then found out my prior employer was fighting the claim. Went to arbitration, the arbitrator found in my favor. Now I have received notice that the prior employer is appealing the decision. Does anyone have any idea how many times this can happen? How many appeals does he get? If he wins the appeal I have to repay the benefits.

Usually, once a decision is reached by an arbitrator, it is final.
What grounds is the bastard you worked for alleging?

(Only experienced this ONCE, via a friend...and it went to an actual judge rather than an arbitrator. My friend won in a matter of minutes. Friend was fired by phone message: "Don't come in Monday, the doors will be locked and I'll contact you when you can pick up your things." BUT it was an old machine with a tape cassette when the employer claimed he quit, the judge was given the tape to listen to. The old witch/empolyer should have been jailed for attempted fraud.

My experience is that the State gives the presumption to the person on Unemployment. They have seeen too often the most outrageous behavior of employers...especially with the "She quit...no, I was fired" argument.




Can I presume the State will continue your claims pending resolution of the claim; that sounds logical. But yes, if you lose you will have to pay back the money...unless YOU appeal!
