The 30 days you mention, is properly the 30 day eviction notice. After the 30 days is when you can go to court and request an eviction. If the tenant show up, they would ask both party to come into an agreement. If not, then the process would take longer. In New York Tenant law, when you evict most likely they won't have to pay rent from eviction process on ward.

As indicated in the link, the petition of removal started when you 1st started court proceedings against your tenant.

I am down on marshalls...we got a $10,000 judgement against someone who HAD the money. Incompetent marshalling got us nothing.
Until I hear some success stories, I must assume marshalls are a complete and utter waste of taxpayer money.

Can you tell me more about your situation?

I thought the marshalls only take care of removing tenants from property. Are they also involved in trying to claim back rent?

Marshals claim any judgment awarded in court. If a business owes u money marshals go after they bond.

For us it was a violation of an employment contract and a court judgement in our favor.

I have to ask any attorneys on this board:

Can a tenant be held in contempt of court if a so ordered stip to leave has not been complied with, given that the tenant's request for an extension has been denied?
