Ok going to try to make this short. I share an apartment with my son and 80 year old mom who I take care of. My landlord passed away not to long ago and her children just sent me an email asking us to be out my the end of January. I told him we needed more time and his response was we had no rights because the apartment is illegal. Now I have been living in this apartment for ten years. If he's right and the apartment is illegal is there anything that I can do or does he have the right to ask us to leave. Can someone please tell me what I can do. Also it's a privet home with two apartments above my walkin apartment.

Get an lawyer. If you cannot afford a lawyer call legal aid or the MET housing council. Do not accept advise from the message board on a serious issue like this. Time is of the essence.

Default Illegal aparment

You cannot be evicted from an illegal apartment without legal proceedings in civil court. It's quite expensive for the owner and you are not obligated to pay rent during this period. Proceedings will take more than 6 months and eventually you would have to vacate the apartment. Visit www.nyc.gov, Department of Housing Preservation for more information.
