The tenant living in the side door apartment of our home refused to give us rent this month due to her cleaning expenses. The tenant had a termite problem (our home was not affected, just her apartment- her kitchen to be exact). As landlords we took care of the problem and spent 2,000 dollars on an exterminator. She apparently got her OWN PERSONAL carpets that are solely owned by her in other rooms steam-cleaned and also hired cleaning services to clean the apartment. She stated that because her cleaning expenses were equal to the rent she pays that she was not going to pay rent. Are the landlords obligated to pay for her cleaning expenses? No one asked her to hire a cleaning service or to get her carpets cleaned at our expense. She did this on her own because apparently she cannot clean her apartment on her own for whatever reasons (not health related). Please any advice can help. Additionally, we asked her for receipts and some date to way before the termite problem even occurred in addition to her grocery bills!!!!!!!! and a bill for lamp shades!!!

Don't pay. Let her sue you. I believe a judge wouldn't side with her due to her not coming to you beforehand and presenting an estimate first or also just suing you for damages in which a judge would decide if you were responsible. Not to mention some other cheaper remedy that would have been better. Just sounds like she was miffed and wanted to ********* over the problem. I mean she could have had you rent a steam cleaner and done it herself or even had someone you hired for a low fee clean the rugs. Some people will try to exploit any and everything.

If she refuses to pay rent then move to evict her in court and sue for back rent. She'll probably counter sue for those expenses she claims you're responsible for.

@luvnyc, thank you very much for your input. I had drawn the same conclusions. It is a relief hearing the same thing from someone else. She has threatened us saying that she will not leave after her notice of termination and that she will not pay rent and live in our apartment for free for 6 months. She also stated that she will "break" everything in the apartment. She is very hostile and has been driving us crazy with loud music and stomping her feet all night long. Hopefully she will leave, but yes the next step is to go to court.

Oh you're welcome.

She sounds like a real winner, really crazy.

Document everything. Call police when she creates a disturbance.

There are many LLs and legal professionals here that can give you valuable information on how to preceeding from here. Sounds like you have a doosy for a tenant.

Start the eviction process, now. There's preliminaries before you even go to court; check with your lawyer.

The tenant is trying to be slick and stick you for a month or rent. Ask the tenant to give you the cleaning receipt from the cleaners. If she does, go to the cleaners to verify that its a legit receipt and that the tenant in fact did drop off clothes.

The tenant should of consulted with you first before taking it upon herself to clean her entire closet out. I call BS on this one.

Remember, you as the landlord call the shots. If ultimately you wind up paying for her clothes being cleaned when you think her entire closet filled with clothes getting dirty is an exaggeration, come lease renewal time, a hefty rent increase (higher than you would normally give) is in the call for and will be a nice message to her. That'll shut the tenant up. And since its a cost in itself to move, chances are the tenant will stay and not move.

Here is what I would do. Kick the door down put a gun to her head and tell her either she pays the rent or you are gonna evict her by putting a bullet in her head then roll her up in her beloved carpet and dump her in the east river. Now this only works if you have the balls to pull the trigger other wise this tenant will know that she owns you and will never pay you rent again.

So what's it gonna be OP? WHAT'S IT GONNA BE!?
