Initially I rented my one family home to a family with kids. Turned out that they were not family but just shacking up. Tenant with the larger salary move out and left tenant who has kids and cannot afford the rent. Tenant refused to move (legal one family residence) despite receiving a 30 day notice served by an attorney I hired. On the first day of court, attorney appeared to be working for the tenant. He asked me to make a deal with the tenant which includes reducing the rent or allowing the tenant to live rent free for a couple of months because she can't afford to move and pay rent at the same time. Meanwhile, the tenant already lived out the her security and owes one month's rent. Since I have an illegal apartment in the basement, the attorney said that the judge will not look favorably upon me and will not let me collect back rent from the tenant.

Will the judge stop me from collecting rent from the tenant who refused to move from the house?
