My friend and sister are on the lease of their deceased Mom's apartment in the Bronx. My friend has been living there alone since her mom passed two years ago.
My friend wants to have her sister's name removed from the lease but she is afraid that because their combined income meets the income requirement she will lose the apartment.
She says she can pay the rent on her own but wonders if the Management company will let her do this.
It is a two bedroom.
Does anyone have experience with this?
She is late with rent (she is paying it in full on Monday) and she is a month late handing in the lease renewal.

You can't remove someone from a lease just like that. You have to get a signed notarized statement from the person themselves that they want to be removed from the lease. Once that happens, then that's when income, etc, is taken into account. The good news is that they won't be able to kick her out because of her income alone, though. A landlord can only kick someone out if they fail to pay the rent or fail to meet some other criteria on the lease.
