So I don't want to use a broker. But sadly my wife was shown an apartment without me. I had already found an apartment I like without a broker. Both the apartments are in the same building. Will I get sued for not paying the broker even though it isn't the same apartment (same building different apartment).

Divorce your wife, sign for the apartment you found, then either remarry your ex-wife or live that bachelor life. Good luck

Look at contract signed with broker. Most have boilerplate language that states they get paid even if you find same apartment on your own.

That being said how much time elapsed between your wife being shown this apartment and you seeing the other? If you saw the other first, then it would be hard for broker to make his claims (but likely will try). OTOH if your wife saw apartment on say a Monday, and you found the other on Wednesday broker could make the case she told you about things and thus you two are in cahoots.

Again look at contract signed with broker and see what it says; that is really what governs if you're on the hook or not. You're not the first to pull this, so be prepared for broker to push back and want his (or her) taste.
