I filed a claim in small claims court, and was surprised when the producer of one of those shows called me and invited me to come on the show. It was an odd case, true, but I just laughed and refused. I knew I was going to win in court in a case against a small business -- I had police reports, photos, receipts, witnesses, etc., and the business owner was playing the "my dog didn't bite you, that's not a bite, I don't own a dog" card.

And yes, I did win. :-) No way I was going to give that jerk a free trip to anywhere, and I wanted HIM to pay what he owed, not weasel out of paying by showing up on TV and smirking.

I do have proof. I wired it from my bank account to her bank account at the same bank.

That is not proof it was a loan and not a gift; only that the money started out in your account and ended in hers, and that you initiated the transaction.

Good point, a parent can take money out of their account and have it sent to their child who is in college.

This woman can just say it was a gift.

OP, I think at this point with all the time that has passed consider it an expensive lesson in life.

You have proof you gave her money. You need proof that both of you agreed that it was a loan.

You need proof via text messages or emails that she acknowledges it was a loan. You don't necessarily need to have all terms spelled out, but you need something that says you asked for the money and her replying back "you'll get it soon" or "I can't pay you back right now" or something where she's not saying "I don't owe you anything". If she acknowledges she owes you, that's all you need.

If you have the texts of her saying she won't pay you back bc you're rich, you'll be a blast on Judge Judy.

Sometimes just the threat of legal action is enough.

This ^^^^^^

Do you personally know a lawyer that could draft the letter and send out on his letterhead? Sometimes that is all it will take.

I insisted on getting a note signed. My CPA is not crazy about my situation (loaning friend money), so I am pursuing it in small claims court.. if I win a judgement It will be awful hard to ignore.

If not, time for another CPA.
