Does anyone know what the settlement was between the two? Will Amazon.com provide the total purchases to NC now? Also are there other online retailers that are providing the state with purchase info?

BTW I was going to buy something on Overstock.com today and was shocked to see a tax line added to my total. So I am assuming no use tax for this purchase, right?
For those that didn't know, like Amazon, Overstock does not have a physical presence in NC and has never collected tax in the past.

Overstock.com: Sales tax will be charged to all orders that are processed with a North Carolina shipping address, regardless of the location the product ships from. Remote sellers, such as Internet retailers and catalog companies are required to collect taxes in states where the company has a physical presence. Due to a recent change in North Carolina, we are collecting sales tax at check-out for orders shipping to North Carolina.

Not sure what "recent change" Overstock.com is talking about, but Amazon.com is not currently collecting sales tax on NC orders. Last fall, the U.S. District Court in Seattle ruled against the North Carolina Department of Revenue. The court said the retailer did not have to provide the state with personally identifiable information related to sales made to North Carolina residents. However, residents are required by law to pay their own use tax on items when an online retailer doesn’t charge sales tax, but few do.

I'm not sure what happened with Overstock, but I believe the NC/Amazon issue was essentially settled in Amazon's behalf. NC DOR sued Amazon for NC customer data so presumably DOR could assess tax against the those citizens. The courts essentially told DOR they could not force Amazon to divulge the data.
