What happens if you bought a gift for someone, bill NC address, shipped to out of state address? Item never sees light of day in NC..Is NC entitled to "Use" tax?

I so hope Amazon does win this one.... this would open up a huge barrage of additional and unfair taxes for all users of amazon and set an awful precedent for online shopping. Normally speaking, if you sell a used CD to a friend or yard sale or such, 99.99% dont keep records of that and pay taxes on it... and this type of thing could affect buyers and sellers in the long run, with all sorts of taxes and would only lead to a huge drop in people using Amazon... and later it could reach to ebay, ioffer, etc, etc, etc and on and on.....

AND the whole other issue is that I dont want the government to be able to get a list of what books I read, or what music I listen to or what movies I watch.... as that has a huge slippery slope mess attached to it as well!!!!

How does Amazon losing help? If they lose, NC gets all the information they want and so will other states.

It's not as much the taxes, which is bad enough, but I don't think the state of NC has the right to look at what books people are reading, which DVDs people are watching, etc etc.

I am guessing that would be considered the same in their eyes as if you had bought something locally and shipped it to someone.
