I am in my thirty's and I have NEVER ever been in any trouble until now...

After a horrible and regretful decision to drink and drive, I blew over a .15 BAC in Fairfax County and from what I read, that involves a MANDATORY 5 day jail sentence....


Does anyone have any experience? I have already retained a lawyer, but just wondering if anyone has any first-hand accounts of how things went down, and the eventual results...

My lawyer said they'll try to get a plea bargain, and in their opinion, I won't see jail time, but they can't guarantee anything (not to mention this is what the lawyer told me before I signed a contract and paid the lawyer).

I can't afford to go to jail... Also, realistically when should my lawyer know when the plea offer is?

I don't know anything about the timeline, but our neighbor got a DWI and he got a suspended sentence of 30 days, lost his license for one year, and has to attend an alcohol education program. He's blown that off and has to go back to court to face that charge.

11 years or so ago, my husband got a DUI. He didn't receive any jail time (other than having to spend that one night in the holding cell), but his license was restricted (which meant he could ONLY drive to work and back with no stops in between), he had to attend 2 AA meetings (he's not an alkie) and VASAP meetings which if I recall correctly were once a week for 6 weeks.

But look on the bright side - you didn't have an accident that seriously hurt or killed anyone.

I bet you could afford going to jail for awhile. They will probably give you free food and a warm place to sleep.

Besides, you might even gain some insight and improve your life. Didn't Martin Luther King write some famous letters from a jail in Birmingham?

Of course, the main thing you should do while in jail is to thank God you did not hurt someone when you drove drunk. If that had happened, you would be going to prison for a long, long time.

That is not completely true. If you hit someone then you would go to jail but not super long. If you kill someone, then you get a longer sentence.

UGH! too bad self-righteousness isn't a crime punishable by imprisonment...


anyway OP, I don't know from personal experience, but one of my ex-b/f's friends caught a dui charge. He got his license suspended for a year and had to attend the classes every week. No jail other than the mandatory night after the offense. This was about 3 years ago, so I don't know if this has changed.

Wow, some of these responses are ruthless!! Everyone has fallen short, so he who is without sin cast the first stone .

I know someone who was caught drinking and driving on her 35th birthday (first offense ever) in Loudoun. She spend 5 days in jail (initially), one year of restricted driving (only to work and child's daycare), breathalyzer in her car for a year and for 4 weekends in the slammer!! She was devastated financially, emotionally, and mentally. With that said, prepare yourself either way for this enormous ordeal, its not going to be an easy road sister.

I got arrested for DUI one night in 1995. I had to spend the night in the Fairfax County Jail and was released at 6:30am the next morning. My license was suspended for 5 days.

Get yourself a lawyer. Mine was able to use a "double jeopardy" defense claiming that once the night magistrate suspended my license for 5 days any further suspension or punishment was the same as convicting me twice for the same offense.

The judge agreed and dismissed the case when it went to court. There is NO RECORD of a DUI on my license. They even lost the speeding charge which is what I was originally stopped for!

I've never had a DUI but my cousin did and he had 6-7 months restricted license (couldn't drive at all), mandatory counseling/classroom time, and the fee$$ for the charge. it could've impacted his employment too as his job was also informed (he worked for the state).
